Neethling on Personality Rights by Neethling, Potgieter and Roos is the updated, revised and expanded version of Neethling’s Law of Personality (2nd edn 2005) by Neethling, Potgieter and Visser (which was originally based on Neethling Persoonlikheidsreg (4th edn 1998)). This new title unfortunately appears without a contribution from Professor PJ Visser, who passed away during 2007. However, Professor A Roos joined the team with her contribution on data privacy law concerning the protection of personal information in South African law.

Available judgments, legislation and literature up to December 2018 have been considered for inclusion. Moreover, in order to accommodate readers who are not proficient in Afrikaans, Dutch, German and Latin, texts in these languages have been translated into English.

The book is intended to be a comprehensive exposition, first of the doctrine of the law of personality which recognises rights of personality as an independent, separate group of (subjective) rights, and second of the basis for and extent of the protection of personality rights in South African law. The recognition and protection of the different personality rights in positive law are reflected as fully as possible. Although the primary focus is on the field of application of the actio iniuriarum and to a lesser extent on that of the action for pain and suffering, relevant criminal law and particularly the influence (and possible influence) of the constitutional Bill of Rights on the law relating to personality rights are also considered. Furthermore, the protection of personal information under the Protection of Personal Information Act 4 of 2013 (POPI Act) is discussed fully. The book should therefore be useful to students, practitioners and the judiciary alike.
